SOUTH AFRICA DRAWS THE LINE FOR MOVING CRYPTO OFFSHORE
The country’s first detailed cross-border crypto framework turns a grey area into a compliance question for users, exchanges and banks.
THE FACTS

South Africa has published draft rules explaining when a crypto transfer becomes a regulated cross-border transaction. A transfer would fall inside the framework when crypto moves from a locally authorised provider to an offshore provider or to a private, non-custodial wallet.

The transfer would have to pass through an authorised channel and be reported to the Reserve Bank’s Financial Surveillance Department. Buying or selling crypto in rand through a local provider would not trigger the same cross-border report.

For now, only individuals would be allowed to move crypto offshore, within existing foreign-currency allowances. Comments are open until September 30.

OUR VIEW

The important change is not that South Africa is β€œregulating crypto.” It is that the country is separating an ordinary local trade from an offshore movement of value.

Licensed exchanges will need reporting systems and controls for transfers into private wallets. For users, the offshore route may become more formal, but also more predictable. The test is whether lawful transfers become easier without pushing activity towards unlicensed channels.

OTHER VIEWS
Treasury and the Reserve Bank say the framework is intended to prevent crypto from becoming a back door around capital-flow rules. Crypto businesses will be watching whether the reporting duties and wallet treatment are practical enough for legitimate use.
